HOLIDAYS, SERVICE INCENTIVE LEAVES AND SERVICE CHARGES


Art. 94. Right to holiday pay.

  1. Every worker shall be paid his regular daily wage during regular holidays, except in retail and service establishments regularly employing less than ten (10) workers;
  2. The employer may require an employee to work on any holiday but such employee shall be paid a compensation equivalent to twice his regular rate; and
  3. As used in this Article, "holiday" includes: New Year’s Day, Maundy Thursday, Good Friday, the ninth of April, the first of May, the twelfth of June, the fourth of July, the thirtieth of November, the twenty-fifth and thirtieth of December and the day designated by law for holding a general election.

Hi, readers! As you know, 3 days ung holidays natin ngayong week na to: April 9 (Thursday) na minove ng Monday, Maunday Thursday on the same date, at saka ung Good Friday sa April 10. These are regular holidays as per Proclamation No. 1699, thus, we are entitled to 200% compensation. Halimbawa, ang sweldo mo sa isang araw ay 800 pesos. Ibig sabihin, susweldo ka ng 1,600 pesos that day sa isang kondisyon: papasok ka sa araw na yon. Ang tanong ngayon ay ganito: Pwede ba akong hindi pumasok sa holiday na yon? Ang sagot ay ito: Oo. The next question is: Babayaran ba ako kung hindi ako papasok? Sagot: Oo, pero 100% lang. In other words, yong regular rate mo lang that day ang bayad sau. Sa case na to, babayaran ka ng 800 instead of 1,600 pesos. Eh pano kung ung regular holiday na yon ay rest day ko? May additional compensation ba? Wala, kung hindi mo papasukan. 100% of your daily wage pa din. Kung papasukan mo naman, makakatanggap ka ng 30% ng 200% ng sweldo mo. Sa kasong to, magiging 30% of 1,600 + 1,600 = 480 + 1,600 = 2,080 pesos. Ang laki din, sayang kung hindi papasukan. Sa isang araw lang yan. Eh may 3 regular holidays tau this week. Klaradong-klarado po yan sa batas natin (Article 94b ng Chapter 3, Labor Code of the Philippines).

For employees like me, maging mapagmatyag po tau sa mga payslips natin. Baka naman mamaya eh inaabuso na tayo. Maganda na rin ung alam natin ung mga provisions ng labor code. Sa mga employers, sana naman po ay sumunod tayo sa mga itinatadhana ng batas. Yon lang po.
