In the interest of public service and efficiency, more particularly to facilitate the disposition of cases involving petitions for exemption, complaints, enforcement and implementation of P.D. No. 851 and its implementing rules and regulations, the following guidelines shall be followed:
I. Petition for exemption
1. The Regional Office concerned shall transmit immediately the petition for exemption to the Chairman, Wage Commission with comments and recommendations, if any.
The petition shall contain a sworn statement on the inability to implement the Decree and the reasons, therefore, and shall be accompanied by the following documents and statements:
(a) A certified true copy of the income tax returns for the last two (2) years;
(b) A certified copy of the financial reports for the last two (2) years filed with the Government entities, such as the Securities and Exchange Commission, Department of Trade, Department of Industries and Board of Investments;
(c) A detailed sworn statement of the actual monthly losses not covered by the report required under paragraph (b) above and such other proofs or documents as may be required by the Chairman, Wage Commission to establish such exemption.
2. The Chairman, Wage Commission and the duly designated staff, shall evaluate all petitions for exemption and make appropriate recommendations within 20 working days from receipt of the petition to the Secretary of Labor.
3. Whenever a petition for exemption has been filed, and complaint for non-compliance shall be held in abeyance pending the disposition or resolution of the petition for exemption.
II. Complaint, enforcement and/or implementation
1. All complaints for non-payment of the 13th-month pay shall be filed with the Field Services Division of the Regional Office concerned. The Regional Director shall direct the said Division to conduct an inspection and investigation in connection with the complaint filed.
2. The Field Service Division of the Regional Office concerned shall see to it that all covered employees comply with P.D. No. 851.
The Regional Director shall submit a monthly progress report of compliance with the Decree.
The reports of the Regional Offices shall be submitted to the LSS and BLS, and shall contain the following:
(a) The total number of establishments;
(b) total number of workers benefited; and
(c) total amount of benefits paid.
3. The Regional Office shall compile, analyze and evaluate compliance reports and update the listing of establishments on the basis of the reports submitted.
Any prior order, circular, instruction or memorandum or parts thereof, inconsistent herewith are hereby revoked.
This Order shall take effect immediately.

Last Sunday, I attended the worship service at Victory Christian Fellowship in Robinsons Galleria Ortigas at exactly 7:30 in the evening. The church was packed with worshippers. I think most of them were working in the nearby companies ending the work shift at around 6pm. It was Pastor Ferdie Cabiling, the senior pastor, who shared the first part of the preaching series called "Ancient Prophecies."
The main text used in the preaching was found in Isaiah 7:14, "Therefore the Lord himself shall give you a sign: Behold, a virgin shall conceive, and bear a son, and shall call his name Immanuel." It was a prophecy given by Isaiah to the people of Israel. There was a threat against Israelites, and as usual, it was a threat from the foreign kingdoms sorrounding Israel. In fact, throughout Israel's ancient history, she has been subdued by different invaders such as the Egyptians, Babylonians, Persians, and Romans. Imagine the hardships and maltreatment they received from those oppressors. In spite of all these, being the chosen people of God, God Himself provided a solution. He spoke to Isaiah to tell the people of Israel that God was giving them a sign. So Israelites were very happy including the king. I think the Israelite nation was expecting something that was great and mighty like an army to help them. But they were wrong. God gave them the sign: the birth of a baby which would be named as Immanuel meaning God with us. King Ahaz did not accept this. It was totally unbelievable, far from the truth. Instead of believing Isaiah, King Ahaz connived with the enemies. The rest is history. God used the enemies to teach the children of Isarel to trust in Him no matter what.
While Pastor Ferdie was sharing all these things, my mind was focused to our nation, Philippines. I thought of Israel as the Philippines. For few weeks now, we are being bombarded with so many negative news about the country, especially the Maguindanao massacre where 57 people were killed by the supposed powerful political clan in Maguindanao, the Ampatuans. I relate the situation of the Filipinos to those of Israelites, wandering in the desert, asking each other if there is still hope for our country. For years, Filipino Christians are praying for leaders in the government that their minds may be enlightened, and pursue the goal of righteousness in governance. We've been praying for righteous leaders to come out and stand for us. Now, God is giving us the sign that we still have hope - that God will never forsake us.
If we really want a geniune change for our nation, pray that God will work in the heart of every Filipino to vote for candidates in 2010 elections who have the heart and passion to serve the people. No more to self-vested interests. Vote for candidates who are righteous - candidates who have God in their lives, who are serving Him faithfully. You have been praying for righteous leadership in the government - now God is giving us the SIGN. Believe in the sign, transform your belief into a very important political decision you are going to make in May 10, 2010, and put your trust in God that He will do the rest.
This nation will rise soon. Let's unite and stop doubting.

1. Contractors and Subcontractors, including Security and Watchman Agencies, are exempt for the year 1975 subject to the following conditions:
(a) that the contracts of such enterprises were entered into before December 16, 1975;
(b) that such enterprises have complied with all labor standards laws during the year;
(c) that the contract cannot really accommodate 13-month pay or its equivalent; and
(d) that the contract does not provide for cost escalation clause.
This exemption is without prejudice on the part of the workers to negotiate with their employers or to seek payment thereof by filing appropriate complaints with the Regional Offices of the Department of Labor.
2. Private school teachers, including faculty members of colleges and universities, are entitled to 1/12 of their annual basic pay regardless of the number of months they teach or are paid within a year.
3. New establishments operating for less than one year are not covered except subsidiaries or branches of foreign and domestic corporations.
4. Overtime pay, earnings and other remunerations which are not part of the basic salary shall not be included in the computation of the 13th-month pay.
5. In view of the lack of sufficient time for the dissemination of the provisions of P.D. No. 851 and its Rules and the unavailability of adequate cash flow due to the long holiday season, compliance and reporting of compliance with this Decree are hereby extended up to March 31, 1976 except in private schools where compliance for 1975 may be made not later than 30 June 1976.
6. Nothing herein shall sanction the withdrawal or diminution of any compensation, benefits or any supplements being enjoyed by the employees on the effective date of this issuance.

TITLE: GOD'S PROMISE OF RESTORATION
BACKGROUND: During the 4th century B.C., the Prophet Joel describes a terrible invasion of locusts and a devastating drought in Palestine. The crops have been devours by locusts, and the graveyards have been destroyed.
MAIN POINTS:
1. I will give you back what you lost in years...
--We have something in possession that was taken away from us - and these refer to blessings we enjoy in this life.
--If we fail to hear the voice of the Lord, i.e., if we backslide from our faith, we will lost these blessings and opportunities for years.
--But if we take heed to His warnings and turn back to God, He will give us back what is lost. This is a promise that God gave us.
2. ...when swarm of locusts ate our crops.
--Crops refer to the blessings of God we enjoy, while locusts refer to trials we are experiencing as human beings.
--It is described here that these problems are not simply locusts but swarm of locusts, meaning these trials and temptations are too many and big enough to devour us and make us fall.
3. It was I who sent this army against you.
--Here, God is explicitly saying that it is He who will send these trials to test us. How pure is our faith in Him will be tested through trials and temptations.
--For what reason God is giving us these trials? To give us a lesson.
This scenario is for all of us. We know our calling. We are called by God to serve Him faithfully without reservations. In our Christian life, there are ups and downs. We praise God if are on fire in our service to Him. But we must also be thankful if we experience trials in our life. To test our faithfulness to the Lord, He sends "swarms of locusts" upon us. If we are not on guard, these locusts will eat our crops - the blessings we enjoy, the potentials we have, our strengths. That's why God speaks to us daily through His Word to be on guard because the enemy is like a roaring lion ready to devour us.
Every one of us has his own locusts in life. Some Christians could stand still and continue serving the Lord. They endure. But others may fail. They may be completely destroyed spiritually or backslidden. There is hope. When we turn away from our sins, realizing that God is offering His hands to us, He will surely restore us. He is making a promise that He will give us back what we lost. With this, the Lord is speaking to us through the Prophet Isaiah: "Do not cling to events of the past or dwell on what happenned long ago. Watch for the new thing I am going to do. It is happening now already - you can see it now! I will make a road through the wilderness and give you streams of water there." (Isaiah 43: 18-19) What a beautiful promise! This is God's promise of restoration to those who take heed of His warnings.

This has got to be one of the funniest things I've heard of in a long time. I think this guy should have
been promoted, not fired.
This is a true story from the "WordPerfect Helpline" which was transcribed
from a recording monitoring the customer care department. Needless to say, the Help Desk employee was fired; however, he is currently suing the WordPerfect organization for "Termination without Cause." This is the actual dialogue of a former WordPerfect Customer Support employee. (Now I know why they record these conversations).
"Rich Hall computer assistance; may I help you?" "Yes, well, I'm having trouble with WordPerfect."
"What sort of trouble?"
"Well, I was just typing along, and all of a sudden the words went away."
"Went away?"
"They disappeared."
"Hmmm. So what does your screen look like now?"
"Nothing."

"It's a blank; it won't accept anything when I type."

By virtue of the powers vested in me (President Ferdinand Marcos) by law, the following rules and regulations implementing Presidential Decree No. 851 are hereby issued for the guidance of all concerned.
Section 1. Payment of 13th-month Pay. - All employers covered by Presidential Decree No. 851, hereinafter referred to as the "Decree", shall pay to all their employees receiving a basic salary of not more than P1,000 a month a thirteenth-month pay not later than December 24 of every year.
Sec. 2. Definition of certain terms. - As used in this issuance:
(a) "Thirteenth-month pay" shall mean one twelfth (1/12) of the basic salary of an employee within a calendar year;
(b) "Basic salary" shall include all remunerations or earnings paid by an employer to an employee for services rendered but may not include cost-of-living allowances granted pursuant to Presidential Decree No. 525 or Letter of Instructions No. 174, profit-sharing payments, and all allowances and monetary benefits which are not considered or integrated as part of the regular or basic salary of the employee at the time of the promulgation of the Decree on December 16, 1975.
Sec. 3. Employers covered. - The Decree shall apply to all employers except to:
(a) Distressed employers, such as (1) those which are currently incurring substantial losses or (2) in the case of non-profit institutions and organizations, where their income, whether from donations, contributions, grants and other earnings from any source, has consistently declined by more than forty (40%) percent of their normal income for the last two (2) years, subject to the provision of Section 7 of this issuance;
(b) The Government and any of its political subdivisions, including government-owned and controlled corporations, except those corporations operating essentially as private subsidiaries of the Government;
(c) Employers already paying their employees 13-month pay or more in a calendar year or its equivalent at the time of this issuance;
(d) Employers of household helpers and persons in the personal service of another in relation to such workers; and
(e) Employers of those who are paid on purely commission, boundary, or task basis, and those who are paid a fixed amount for performing a specific work, irrespective of the time consumed in the performance thereof, except where the workers are paid on piece-rate basis in which case the employer shall be covered by this issuance insofar as such workers are concerned.
As used herein, workers paid on piece-rate basis shall refer to those who are paid a standard amount for every piece or unit of work produced that is more or less regularly replicated, without regard to the time spent in producing the same.
The term "its equivalent" as used in paragraph c) hereof shall include Christmas bonus, mid-year bonus, profit-sharing payments and other cash bonuses amounting to not less than 1/12th of the basic salary but shall not include cash and stock dividends, cost of living allowances and all other allowances regularly enjoyed by the employee, as well as non-monetary benefits. Where an employer pays less than 1/12th of the employees basic salary, the employer shall pay the difference.
Sec. 4. Employees covered. - Except as provided in Section 3 of this issuance, all employees of covered employers shall be entitled to benefit provided under the Decree who are receiving not more than P1,000 a month, regardless of their position, designation or employment status, and irrespective of the method by which their wages are paid, provided that they have worked for at least one month during the calendar year.
Sec. 5. Option of covered employers. - A covered employer may pay one-half of the 13th-month pay required by the Decree before the opening of the regular school year and the other half on or before the 24th day of December of every year.
In any establishment where a union has been recognized or certified as the collective bargaining agent of the employees therein, the periodicity or frequency of payment of the 13th-month pay may be the subject of agreement.
Nothing herein shall prevent employers from giving the benefits provided in the Decree to their employees who are receiving more than One Thousand (P1,000) Pesos a month or benefits higher than those provided by the Decree.
Sec. 6. Special feature of benefit. - The benefits granted under this issuance shall not be credited as part of the regular wage of the employees for purposes of determining overtime and premium pay, fringe benefits, as well as premium contributions to the State Insurance Fund, social security, medicare and private welfare and retirement plans.
Sec. 7. Exemption of Distressed employers. - Distressed employers shall qualify for exemption from the requirement of the Decree upon prior authorization by the Secretary of Labor. Petitions for exemptions may be filed within the nearest regional office having jurisdiction over the employer not later than January 15, 1976. The regional offices shall transmit the petitions to the Secretary of Labor within 24 hours from receipt thereof.
Sec. 8. Report of compliance. - Every covered employer shall make a report of his compliance with the Decree to the nearest regional labor office not later than January 15 of each year.
The report shall conform substantially with the following form:
REPORT ON COMPLIANCE WITH P.D. NO. 851
1. Name of establishment
2. Address
3. Principal product or business
4. Total employment
5. Total number of workers benefited
6. Amount granted per employee
7. Total amount of benefits granted
8. Name, position and tel. no. of person giving information
Sec. 9. Adjudication of claims. - Non-payment of the thirteenth-month pay provided by the Decree and these rules shall be treated as money claims cases and shall be processed in accordance with the Rules Implementing the Labor Code of the Philippines and the Rules of the National Labor Relations Commission.
Sec. 10. Prohibition against reduction or elimination of benefits. - Nothing herein shall be construed to authorize any employer to eliminate, or diminish in any way, supplements, or other employee benefits or favorable practice being enjoyed by the employee at the time of promulgation of this issuance.
Sec. 11. Transitory Provision. - These rules and regulations shall take effect immediately and for purposes of the 13th-month pay for 1975, the same shall apply only to those who are employees as of December 16, 1975.

REQUIRING ALL EMPLOYERS TO PAY THEIR EMPLOYEES A 13th-MONTH PAY
WHEREAS, it is necessary to further protect the level of real wages from the ravage of worldwide inflation;
WHEREAS, there has been no increase in the legal minimum wage rates since 1970;
WHEREAS, the Christmas season is an opportune time for society to show its concern for the plight of the working masses so they may properly celebrate Christmas and New Year.
NOW, THEREFORE, I, FERDINAND E. MARCOS, by virtue of the powers vested in me by the Constitution, do hereby decree as follows:
Section 1. All employers are hereby required to pay all their employees receiving a basic salary of not more than P1,000 a month, regardless of the nature of their employment, a 13th-month pay not later than December 24 of every year.
Sec. 2. Employers already paying their employees a 13th-month pay or its equivalent are not covered by this Decree.
Sec. 3. This Decree shall take effect immediately.
Done in the City of Manila, this 16th day of December 1975.

I really don't know her specific achievements done for Taclobanons during her three-year term, but when I spent a four-day vacation in Leyte, I noticed several changes in the city: (1) There's already a Robinsons Mall which is really, really good. (2) The old, big building which is used to house the Smart telecommunications office was gone. It was replaced with a salon named after her.
I've seen Kring-kring personally twice. First was when his husband, Tacloban City Mayor Alfred Romualdez, and her went to our barangay. I really couldn't think what they did there. I was a small kid that time. All I know was that they kept on shaking hands with the folks and I saw Cristina applying alcohol all over her hands after she shook the "dirty" hands of my kababayans. That scenario is very, very clear to my mind and I always remember that. Second was when I attended a church service at Victory Christian Fellowship at Robinsons Galleria in Ortigas just two months ago. She and her husband went to the stage wherE Pastor Cabiling interviewed them, and they told the congregation that they are planning to plant a church in Tacloban City. They are Christians I thought.
I just hope that she would use the position given to her by God to serve Taclobanons in her full capacity.

Eddie Villanueva has chosen to field-in former Autonomous Region for Muslim Mindanao (ARMM) Governor Nur Misuari to run for Governor in Sulu in order to address the lingering problem of peace and order in Mindanao under the banner of Bangon Pilipinas Party. The Born-Again leader and standard bearer of the party, Villanueva, has filed his Certificate of Candidacy (CoC) with Perfecto Yasay, former Securities and Exchange Commision (SEC) Chairman, as his Vice Presidential running mate.
Misuari pointed out that his alliance with Villanueva is the key towards a lasting peace in the region where the conflict among Muslims and Christians has remained unresolved for centuries. Seeing Bro. Eddie’s earnestness of purpose and being a true person of faith, the need for “Righteous Governance” can now be fully achieved.
It will be remembered that Villaneva ran for President in 2004 and lost to President Gloria Macapagal Arroyo. This time though,Villanueva said that they are prepared with enough volunteers and resources for the coming election. He added that they are banking on the support of his fellow JIL church members and barangay officials. Unknown to many, Bangon Pilipinas has been silently preparing for this coming poll since two years ago.
For their senatorial line-up BPP has endorsed news journalists Kata Inocencio and Alex Tinsay among others. They are boasting on their dream team of Senatoriables whom they refer as “Magnificent Seven” and each represents the various sectors of our society.

"We are confident that this one is covered by the Constitution," said Ermita at a press briefing at the Palace.
The announcement was made days after hundreds of government troops were sent to the province, which would later raid armories of the powerful Ampatuan clan.
The Ampatuan family was implicated in a gruesome massacre two weeks ago that saw the murder of 57 persons, including women members of the rival Mangudadatu clan, human rights lawyers, and 31 media workers, in the worst incident of political violence in the nation's history. It's final. President Gloria Macapagal-Arroyo will be running as congresswoman in 2010 elections. She will be filing her certificate of candidacy today. She is barred from running the presidency because the Constitution prohibits her from doing so. She is qualified to run as a senator but why choose Congress? Simple answer for a complicated issue. GMA wants to stay in power beyond 2010. "To me it is a simple lead to poilitical power," says Ernesto Maceda, spokesperson of United Opposition (UNO). If she really wants to serve the people, she should have chosen the Senate seat because she will be elected-at-large unlike for a Congress seat where only voters from the 2nd district of Pampanga will be casting their votes. If she wins, she can persuade her allies in Congress to pursue charter change, dissolve the Senate, and of course the assembly would elect her as the new prime minister.
According to Rep. Teddy Casiño of Bayan Muna, he has never seen a leader so obsessed with power as Mrs. Arroyo. "She is drunk with power and can’t get enough. I think she needs professional help," he further said.

Filipino Muslim women holding a rally
This made me wonder why such bestiality took place in a Muslim area. According to the Quran, the central religious text of Islam, women are equal to men before God. In a website dedicated to issues relating to women in the Muslim world, here's what it says about how men should treat Muslim women:
Narrated Mu'awiyah al-Qushayri: I went to the Apostle of Allah (pbuh) and asked him: "What do you say (command) about our wives?" He replied: "Give them food what you have for yourself, and clothe them by which you clothe yourself, and do not beat them, and do not revile them." (Sunan Abu Dawud: Book 11, Number 2139).
"None but a noble man treats women in an honourable manner. And none but an ignoble treats women disgracefully". (At-Tirmithy).If the prepetrators are really Muslims, ones who submit to the will of Allah, they should first and foremost, adhere to Muhammad's (considered to the last Prophet of Allah) admonition: "Treat your women well and be kind to them for they are your partners and committed helpers."
Otherwise, they belong to certain elite groups in the government who are just hungry for power.

Taking as He did, this sinful world as it is,
Not as I would have it.
Trusting that He will make all things right
If I surrender to His will.
This made me realize one thing:
Life on earth is not that easy.
But God Himself said, “Cast all your cares unto Him
For He cares for you.”
Honestly I would say
That it is hard to let go
But I would rather let God mold me
In His very own and special way.
That You and I may be reasonably happy in this life
And supremely happy with Him forever in the next chapter.
Would you rather strive for something of eternal value
Than be temporarily satisfied with this ephemeral world?
